Auto Accidents - Verdicts and Settlements

Novette v. Ace Trucking-An eighteen wheeler slammed into the back of a car stopped in traffic, launching that vehicle into four others. The driver suffered major closed head injuries and a variety of other ailments. The case involved work with surgeons, physicians, psychiatrists, and pain management specialists.  (Confidential Amount)

Rotella v. Tampa-A family was driving home with a newly adopted baby girl when a man who drove his Cadillac through a stop sign struck them. The mother suffered two broken legs, and the others suffered a variety of bumps and bruises. (Confidential Amount)

Smith and Doakes v. Highway Patrol-A young married couple was traveling through South Carolina on their way to be in a friends' wedding in Virginia. While turning off of the Interstate to buy gas, they were broadsided and killed by a State Trooper. The highway patrolman was traveling over 110 miles per hour on a secondary road while pursuing an individual on a minor traffic violation. A lawsuit was filed and settled under the South Carolina Tort Claims Act. With the assistance of our office, the State Trooper was indicted for vehicular homicide and discharged from the law enforcement field. (Confidential Amount)

Johns v. MEGA-Auto Dealership-Client was on the way to pick up his children from school when his vehicle was struck by a drunk driver, who was driving a loaned vehicle that she had just been provided with by an automobile dealer a few minutes earlier. The client suffered serious orthopedic injuries and we filed a lawsuit. The case was confidentially settled under a theory of negligent entrustment. (Confidential Amount)

Smith vs. Gant Oil.  Fuel Oil delivery truck changed lanes on interstate highway in center of town with signaling. Forced Smith's car into guard rail and highway marker sign post. Facial bones shattered. Trial, Verdict of 185,000 for Smith. (Confidential Amount)

Bahs vs. Orange Freight Carriers - Fully loaded 18 wheeler crosses double yellow line on curvy mountain road hitting client's VW Beetle head on. Serious injuries. Driver of 18 wheeler had far exceeded his allowed hours of driving time and admitted during deposition that he was very sleepy at time of wreck. (Confidential Amount)

Goodson vs.Speedy - Goodson, a 46 year old woman from North Carolina , was traveling outside  Myrtle Beach on way to long weekend on coast. While sitting in passenger seat at a red light, car was rear-ended at high rate of speed by woman talking on her cellphone in large Mercedes. Goodson suffered spinal and disc problems which were extensively treated at Wake Forest University Medical Center. Defense hired accident reconstructionist from Atlanta    who never visited scene but opined it was a 'low-impact' collision and that Goodson could not be injured badly. He claimed he did 37 hours worth of record review and calculations to reach his final opinions. At his deposition, it was uncovered that he had minimal biomechanical training and had signed on to testify against Goodson within one hour of having been contacted by insurance company lawyers and then did 36 more hours of work to 'buttress' the opinion he had already decided to give. Case settled after a Failed Mediation and after Defense Expert's Deposition was taken.(Confidential Amount)
